KUALA LUMPUR: The Malaysian Bar has passed a motion calling for Attorney-General Apandi Ali’s resignation.
The decision was made during the Malaysian Bar’s Annual General Meeting (AGM) today.
President Steven Thiru said that the motion was passed but declined to reveal the vote count for the motion.
He clarified that the motion was a call for resignation just like any other call for resignation but hoped that it would have an impact as the Malaysian Bar was the sole body representing lawyers in Peninsula Malaysia.
When asked whether Apandi was a member of the Bar and whether the Bar could affect his position, Thiru said that Apandi was not a member of the Bar.
Thiru further said that the motion was separate from the judicial review it filed against Apandi’s decisions on investigations into Prime Minister Najib Razak and that the Bar would proceed with the judicial review.
“That will carry on, we will proceed with that.”
Thiru also said that none of the motions passed, including that on Apandi, the censorship of the internet in Malaysia and the National Security Council bill were political in nature.
“The concern is the rule of law and administration of justice and nothing to do with politics.”
The motion on Apandi’s resignation was in relation to concerns over the administration of criminal justice, following his clearing Najib of criminal wrongdoing pertaining to the SRC, 1Malaysia Development Berhad and the RM2.6 billion political donation cases.
It also called for the Solicitor-General to take over the role as public prosecutor in the three cases.
The motion also called for Apandi to resign as a director of Lembaga Tabung Haji and any other positions held in companies, statutory bodies and legal entities except those required by law.
Yesterday, FMT reported that DAP lawmaker RSN Rayer was against the motion on Apandi’s resignation as the AG’s appointment was the prerogative of the King, on the advice of the prime minister.
“There is no way to challenge the AG unless the Federal Constitution is amended to provide a clause for the AG’s removal if he fails to discharge his duties to uphold justice,” he told FMT.
